Terms and Conditions (“Terms”)

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Ovatu online booking service (the “Service”) operated by Abrosia Therapies Pty Ltd (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you are asked to not access the Service.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. Fraudulent or misuse of the online booking system shall be in breach of communication laws and subsequent legal action may be taken.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Online Booking / Acceptance of Terms & Conditions

Online Bookings will not be completed until the Terms & Conditions acceptance has been selected and checked on the booking system. Failure to complete this step will result in bookings not being registered. Acceptance of these terms and conditions is also implied on initial visit by completion & signing of a Client Intake Form prior to first treatment.

These Terms & Conditions are available to read via the link on the Online Booking page prior to making any booking.

Am email or sms message will be sent to your nominated contact confirming the booking has been accepted. If you do not receive a confirmation please contact the clinic.

Cancellation Policy/No Show Policy

1. Cancellation/ No Show Policy for Therapy Appointment

We understand that there are times when you must miss an appointment due to emergencies or obligations for work or family. However, when you do not contact us or call to cancel an appointment, you may be preventing another patient from getting much needed treatment. 

Conversely, the situation may arise where another patient fails to cancel and we are unable to schedule you for a visit, due to a seemingly “full” appointment schedule.

Reminder & Confirmation sms messages and emails are sent 24hrs prior to appointments and again on the day of the appointment if no reply has been received.

If an appointment is not cancelled at least 4 hours in advance you may be charged a 50% cancellation fee; this will not be covered by your insurance company in the event of remedial services.

Failing to Show for your appointment will incur a 100% fee and may require full payment in advance prior to acceptance of future bookings.

2. Scheduled Appointments

We understand that delays can happen however we must try to keep the other patients and therapists on time.

If a patient turns up 15 minutes past their scheduled time, we may have to reschedule the appointment or shorten the treatment time due to subsequent appointments. Full payment for the booked appointment time will be required even in the event of late arrival.

4. Outstanding Account balances

We will require that patients maintain zero balances and payment is required in full upon completion of treatment.

In the event of no show or late cancellations, a payment request may be sent via email and payment required prior to confirmation of further bookings or receiving further services by the practice.

Patients who have questions about their bills or who would like to discuss a payment plan option may call and speak to us about their account and concerns.

Patients will be issued a receipt upon payment of the account for their records.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Abrosia Therapies Wellness Clinic, specifically the OVATU online booking application and OVATUYOU app.

Abrosia Therapies Pty Ltd has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Abrosia Therapies Pty Ltd shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Abuse of the online booking service will not be tolerated and may result in criminal charges for misuse of the service. Tracing of IP addresses, blocking of further activity and legal action may occur in the event of system abuse.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Reasons for Termination may include; but not limited to are failure to attend for a booking (no -show), abuse of the services and online systems through malicious intent.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 14 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Code of Conduct & Complaints Process

Abrosia Therapies operates under the recommended codes of conduct as defined by Massage & Myotherapy Australia. A copy of the the Codes of Conduct may be accessed here.

If you are not satisfied with our service, please contact us. We take complaints seriously and aim to resolve them quickly and fairly.

If you remain dissatisfied with our response, you may contact the Health Complaints Commissioner (HCC). The HCC responds to complaints about health services and the handling of health information in Victoria. Their service is free, confidential, and impartial.

To lodge a complaint with the HCC:

Fill out a complaint form online at hcc.vic.gov.au or Phone 1300 582 113 between 9am and 5pm, Monday to Friday to discuss your complaint.
